Terms of Service

1. Acceptance

By using Clipwise (clipwise.app) you accept these Terms of Service in full. If you disagree with any part, do not use the service.

2. Service Description

Clipwise is a SaaS tool for TikTok content creators. We provide: viral trend search, AI video analysis, content idea generation, trend adaptation, and AI marketing consulting. Features may change, be added, or be removed.

3. User Account

• You must be at least 18 years old (or older if required by local law).
• Registration data must be accurate and current.
• One user = one account. Accounts are non-transferable.
• You are responsible for password security.
• Report unauthorized access immediately at olx2go@gmail.com.

4. Pricing Plans

• Free — free plan with basic limits.
• Pro — $24/mo, extended limits.
• Agency — $73/mo, maximum limits.

Prices may change. We will notify you at least 30 days before any change takes effect. Payments are billed automatically each month until subscription cancellation.

5. Cancellation and Refunds

You can cancel anytime. Access to paid features remains until the end of the current billing period. Refunds for unused periods are available within 14 days of the first payment, per EU consumer law. After 14 days, refunds are at our discretion.

6. Acceptable Use

You may not:

• Use the service for illegal activities.
• Upload content that infringes copyright.
• Upload harmful, abusive, pornographic content, or CSAM.
• Attack the service (DDoS, scraping, reverse engineering).
• Circumvent limits, rate-limiting, or billing.
• Resell access to third parties without written consent.
• Mass-upload third-party videos without rights.

Violations result in account suspension without refund.

7. Intellectual Property

Code, design, and the Clipwise brand belong to us. Content you upload (videos) remains yours. By submitting content, you grant us a limited license to process it solely for service delivery (analysis, report generation). AI-generated reports and ideas are free for you to use.

8. AI Output

AI outputs (analyses, suggestions, ideas) are informational. They are not a guarantee of success, do not replace professional advice, and may contain errors. You decide how to use them. We do not guarantee virality, follower growth, or specific business outcomes.

9. Service Availability

We target 99% uptime but do not guarantee uninterrupted service. The service is provided “as is” without express or implied warranties. Planned maintenance is announced in advance.

10. Limitation of Liability

Clipwise is not liable for indirect damages, lost profits, data loss, or service interruptions. Our total liability is limited to the amount you paid in the last 12 months.

11. Termination

You may delete your account at any time via support. We may suspend or terminate access upon Terms violation. After deletion, data is erased within 30 days, unless law requires longer retention.

12. Changes to Terms

We may update these Terms. Material changes are announced via email or banner at least 14 days in advance. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Ukraine. Disputes are resolved by negotiation first; if unresolved, by courts at Clipwise's place of registration.
